Jonathan Owen Photography Privacy Policy. Updated 7 October 2026.
I am Jonathan Owen, trading as Jonathan Owen Photography, at 22 Whitehall Road, Great Wakering, Essex, SS3 0AA. I am responsible for the personal information I process for my photography and tuition business. For enquiries, email hello@jonathan-owen.co.uk. For privacy requests or complaints, email complaints@jonathan-owen.co.uk or write to this address.
I process personal information under UK data-protection law, including the UK GDPR and the Data Protection Act 2018, as amended. Your rights do not depend on accepting my booking Terms.
I use enquiry and contact details, booking correspondence, event or lesson arrangements, payment and invoice information, and photographs or video from agreed services. Information may come from you, an event organiser or people helping arrange the booking. Photographs can identify people who are not themselves the booking client.
I use this information to answer enquiries, agree and carry out bookings, plan and deliver photographs or tuition, administer payments, deal with requests and complaints, and meet legal obligations. Where appropriate, I use information about accessibility, privacy or safeguarding needs to provide agreed accommodations. Please give only the information needed for the arrangement, rather than unnecessary medical or other sensitive details.
For a client’s personal information needed to take steps they request before a contract, or to perform their contract, the lawful basis is contractual necessity where applicable. Legal obligations support relevant accounting and compliance processing. Legitimate interests may support proportionate business administration, event documentation, delivery and portfolio use where the assessment supports it. I consider purpose, necessity, reasonable expectations and the interests and rights of the people concerned, with particular care for children and sensitive situations.
A client’s contract is not automatically the lawful basis for every attendee’s information. Where consent is the appropriate basis, I will obtain it, and you may withdraw it. Information requiring additional protection is handled only where the relevant legal conditions are met. These bases are applied to the actual purpose, rather than treating every photograph as automatically covered by consent or legitimate interests.
I may use a carefully and respectfully selected number of photographs to show my work on my portfolio, website, social media and relevant business listings where lawful and consistent with agreed restrictions. Separate affirmative portfolio permission is not a standard requirement for every booking, but I may seek permission or decline publication where the circumstances require it.
Please tell me about confidentiality, embargoes, no-promotional-use requests, children or other particular restrictions early where possible. You can also raise later privacy or safeguarding concerns. I honour agreed restrictions and assess objections and other requests individually. A booking client cannot waive everyone else’s rights by accepting the Terms.
Booked-service galleries are private and password-protected unless another arrangement is agreed. You can download the delivered selection at full quality and share the link and password with people you choose. Please consider other people’s privacy and agreed confidentiality before sharing. Client galleries have no fixed expiry date; I encourage you to download and keep your own copies.
I use service providers for business email and records, website operation, payments where applicable and online gallery hosting and fulfilment. Relevant information is shared only as needed for those services and lawful purposes. Google Workspace supports my email and business records. Optional gallery purchases may involve the seller and fulfilment provider identified at checkout. I may also disclose information where required by law or necessary for a properly assessed legal claim. I do not add enquiry details to a marketing mailing list merely because you contact me, or sell them for third-party email marketing.
I retain information for the purpose for which it is needed, taking account of bookings, ongoing client access, accounting obligations, complaints and potential claims. Delivered-gallery availability is distinct from retention of unused photographs, RAW files and editing working files. Different records therefore have different retention needs; indefinite gallery availability is not a promise to retain every working file.
I use reasonable technical and organisational safeguards and restrict access to information needed for the business and its service providers. If a provider processes information outside the UK, appropriate transfer requirements and safeguards must be applied where required. You may contact me for information about relevant recipients, retention and transfer arrangements for your booking.
Depending on the processing and applicable legal conditions, you may request access, correction, erasure, restriction or portability, object to processing based on legitimate interests, and withdraw consent where processing relies on it. Withdrawal does not retrospectively make earlier lawful consent-based processing unlawful. Erasure is not absolute where a record must be retained for a legal obligation or another lawful reason.
Contact me with enough information to identify the record or photograph and your request. I may need proportionate identity checks before releasing information. I will respond within the applicable legal timeframe. If you object to an image’s publication, I will assess the request and take appropriate action, including removal or restriction where required. I cannot promise to recall every copy already printed or lawfully distributed, but will take the steps required by law.
Email complaints@jonathan-owen.co.uk. I will acknowledge a data-protection complaint within 30 days, investigate appropriately and inform you of the outcome. You may also complain to the Information Commissioner’s Office.
Submitting an enquiry lets me respond about your request; it is not agreement to unrelated email marketing. Website analytics and other optional tracking are subject to applicable consent and privacy requirements. Please use the website’s available cookie controls and see the Cookie Policy. External websites and social platforms operate under their own privacy arrangements. Please check them before supplying information.
I will update this policy when processing arrangements change. A policy update does not itself give permission for a new incompatible use of existing information or retrospectively change your agreed confidentiality arrangements.
